Need To Move? Get Skilled Guidance On Child Relocation Issues

There have been recent revisions to the Child Custody Act that created sweeping changes to how relocations are handled. For parents who have custodial arrangements for their child, these changes to the law may affect your or the other parent’s ability to move. The new law redefines relocation as a change in the child’s residence that substantially impairs the other parent’s custodial rights.

In today’s trying economic times, more people may be forced to relocate to secure or maintain employment than at any other time in generations. If you are subject to custody arrangements and are considering relocating or if you are the other parent in such a situation, we can help ensure that your interests are adequately represented in the courts.

How Relocation Impacts Your Divorce Orders

At Laura Robbins Law, L.L.C., our State College child relocation attorneys understand how important it is to preserve your relationship with your children while balancing economic factors and other reasons as to why a move may be necessary. We bring extensive experience and skill on a wide range of family law matters, including a great deal of experience in litigating family law matters, which allows us to provide our clients with the exceptional representation they deserve.

Pennsylvania law regarding relocation calls for the parent who wishes to relocate to notify the other parent by certified mail at least 60 days before any move. The other parent then has 30 days to file a response to that notice. If the nonrelocating parent fails to respond, the court must approve the relocation. The nonrelocating parent may also consent to the relocation. When consent or approval from the court is gained, a proposal for a new parenting plan must be submitted.
